Reaching critical point

With the compensation culture occupying the media, pleural plaques spreading alarm and the cost of personal injury claims rising, the industry has reached a critical point where, as Bill Paton writes, change to the compensation system is not only desirable but inevitable

The Government's Compensation Bill is now being considered in Parliament and the Incapacity Green Paper is finally being scrutinised. At last, it seems, the focus of attention is where it should be - on the need for fairness to claimants.

What concerns insurers is not so much whether we are stuck in a compensation culture but whether the high cost of claims is justified. The main area of concern is personal injury claims. According to the Association of British Insurers (ABI), on average 93p out
