Pleural plaques Scottish Bill 'arbitrary'
The new Scottish Bill which aims to reverse the landmark House of Lords judgment last year, disallowing claims for asbestos-related pleural plaques, has drawn criticism from a number of quarters.
Charl Cronje, partner at consulting actuaries Lane Clark & Peacock LLP, said: The Bill is unhelpful for insurers who thought they had legal finality on pleural plaques claims and now face a return to uncertainty. The Bill arbitrarily deems pleural plaques to be 'a personal injury and 'not negligible' and simply overrides the logic of the House of Lords judgment. Whilst this technically re-opens the door to claimants, it remains unclear how the amount of any financial compensation would beOnly users who have a paid subscription or are part of a corporate subscription are able to print or copy content.
