I was very interested to read Graeme Trudgill's article on the issues surrounding brokers' professional indemnity in a recent edition of Professional Broking ('Avoiding the elephant traps', p33, May).

I have been involved in a number of brokers' negligence cases and often find that brokers fail to advise circumstances to their professional indemnity underwriters as they believe that the client's insurers will pay the original claim.

I suggest that brokers are often too optimistic as to the views of insurers and believe that goodwill will prevail.
