The British Insurance Brokers' Association and the Institute of Insurance Brokers is working with insurers to ensure non-solicitation clauses are included in all new terms-of-business agreements.

The associations are confident insurers will adopt the clause, which protects brokers' client ownership, preventing insurers from approaching clients direct. However, they are yet to see some TOBAs.
