Q: Is it possible for employers to dismiss employees in order toavoid paying out redundancy?
Following a High Court decision, employers faced with making redundancies
have lost their unrestricted power to dismiss an employee for some
independent reason or for no reason at all, thus denying employees their
right to redundancy payment.
In Jenvey v Australian Broadcasting Corporation, Jenvey had previously
asked an employment tribunal to order ABC to give him a statement about
his terms of employment
