It is up to brokers to ensure the insured is complying with the letter of the conditions in their liability policies, to avoid the consequences should indemnity be rejected.

Conditions in insurance policies must be complied with strictly, if
not, then in extreme cases, insurers can decline cover when a claim is
made. It is important for brokers to make sure their insured clients are
complying with the letter of the conditions in their liability insurance
policies.


One recent example illustrates this well. The insured was a builder,
working on the roof of building and connecting a new part of the roof to
an older part. The work required him to use a propane blow torch
