An even liability split.
A recent case has once again brought joint and several liability to the fore in the construction and engineering market. Geoff Lord says the Civil Liability (Contribution) Act 1978 should be amended so that separate parties fulfil their own responsibilities and no-one else's.
On 25 April 2002, the House of Lords gave its judgement onCo-operative Retail Services and Others v Taylor Young Partnership &
Others. The case arose out of a fire on 16 March 1995 at a site in
Rochdale, Lancashire, where a new head office building was being built for
Co-operative Services by Carillion Construction (Wimpey). Hall Electrical
was the electrical sub-contractor, Taylor Young Partnership the architect
and Hoare Lea & Partners the mechanical and electrical consultant.
