Legal warfare over damages.
A recent court case highlighted the problem of judicial bias. Brokers have also been caught in in the legal crossfire over insurance scheme losses.
After the Pinochet case where Lord Hoffman's links with AmnestyInternational resulted in a new hearing, bench warfare broke out as
lawyers alleged judicial bias to appeal lost cases.
Earlier this year, Bill Braithwaite QC, the well-known editor of the
personal injury awards bible Kemp & Kemp and part-time judge, made an
award of £227,000 in a personal injury case (Margaret Timmins v Timothy
Gormley).
The defendant insurers appealed against the award on grounds including
judicial bias. They alleged
