Q: Do I have to provide a reference for an employee, past or present,
if they request one?


A: There is no general obligation placed on an employer to provide a
reference for an existing or past employee.


However if there is a term in the contract stating a reference will be
provided on request, or the employee is a member of the firm's investment
staff and is moving to another regulated firm, you are obliged to provide
a reference.
