Opinion: A broker view one month on from the Insurance Act

Stuart Bennett, operations director of David Roberts & Partners Insurance Brokers outlines how he would handle the Insurance Act if he were an insurer.

Following my previous blog on the day the Insurance Act came into force last month, I have had a number of replies. I think it is fair to say there is no consensus.

A number of insurers are indicating that remedies within the Act are concerned with misrepresentation on things other than the sum insured and so average can still apply as it always has in these circumstances.

I am unfamiliar where it says this in the Insurance Act but I also think that average generally helped a customer
