Having read some recent articles about the Environmental Damage (Prevention & Remediation) Regulations, I have to comment that in view of the length of time that the Environmental Liability Directive (ELD) was anticipated, it is amazing how many companies, including brokers, still believe that all environmental pollution is covered by public liability (PL) insurance.

The legislation poses real potential liability issues for businesses, most of which are not covered by standard PL or property insurance, and presents both great opportunities and real threats for brokers.
