Indecent proposals?

The government has published its main proposals regarding personal injury claims but has it upheld its main objectives of providing claimants with access to justice at a fair cost to the insurance industry? Mike Timmons sets out his views on the proposals

The Ministry of Justice (MOJ) issued its consultation paper - Case Track Limits and Claims Process for Personal Injury Claims - on 20 April with the objective to provide fast, efficient and cost-effective access to justice for claimants at a fair cost to liability insurers and other defendants. In trying to achieve this, the government's main proposals are to:

- Maintain the small claim limits of £1,000 for personal injury, and £5,000 for other claims;

- Increase the fast-track limit to £25,000;
